The Fine Print & Contest Rules – Canada
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Contest Rules and the decisions of Magsmith LLC and Mercer LLC (collectively the “Sponsor”) which shall be final and binding on all matters relating to this Contest.
ELIGIBILITY: The Contest is open to legal residents of Canada who are the age of majority or older in their province or territory of residence at the time of entry. Void elsewhere and where prohibited. Employees of Sponsor, their parent, affiliates, representatives, agents, distributors, retailers, advertising, promotion and judging agencies and the immediate families and household members and persons with whom they are domiciled of each are not eligible.
HOW TO ENTER: Completely fill out the registration form at www.smithmag.net by submitting your name, email address and country of residence and upload an original Six Word Memoir and/or photograph (see details below). By submitting an entry, you are granting Sponsor the right to reprint or republish your entry (including, along with your name and any photograph) in any and all media, including publication in social media or in a book or other publication.
There are four separate Six Words About Work promotions which will take place between June 29, 2011 and August 28, 2011 (the “Contest Period”). During four (4) separate two (2) week periods, enter by submitting your original “Six Word Memoir” – namely a six-word response to the topic set out below. You may also provide a relevant photograph.
Entry periods begin at 12:01 am (Central Time) and end at 11:59 pm (Central Time) on the days stated.
You may enter as often as you like, however each six-word response may be used only once. All entries must be original and created by the entrant.
SELECTION OF POTENTIAL WINNERS: All eligible entries will be judged by a qualified judge shortly after the close of each applicable entry period based on the following judging criteria (“Judging Criteria”):
The entry with the highest total score will be the potential winner for that entry period. In the event of a tie, the tied entries will be re-judged, and if still tied then the highest score in the first Judging Criteria will be the potential winner, continuing thereafter to each Judging Criteria in order, as needed to break the tie. Entrants agree that the judge shall have the sole right to decide all matters and disputes arising from this Contest and that all decisions are final and binding in all respects.
Please retain all submitted entry materials in their original format after uploading. If you are a winner, you may be required to provide your entry materials to Sponsor in the original format as a condition of being awarded a prize. Automated methods of entry are prohibited and any use of automated devices will cause disqualification.
PRIZES: The top scoring entry for each entry period will be able to chose between a Blackberry® Playbook™ 32 GB tablet (ARV $600) and an iPad® 32 GB mobile digital device (ARV $700). The total ARV of all prizes (4 in total) will be approximately $2,400 – $2,800.
Acceptance of a prize constitutes permission from the prize winner for Sponsor and its public relations/promotional agencies to use the prize winner’s name, prize, province of residence, likeness, biographical information, entry and photograph for public relations, advertising and promotional purposes online and in print, or in other media, in connection with the contest without additional compensation.
Each prize is non-transferable. No cash redemption or substitution permitted, except by Sponsor, who may substitute a prize of equal or greater value. Any and all expenses relating to the prizes, if any, are the sole responsibility of the winners.
TERMS & CONDITIONS: Potential winners will be notified by email and will be required to (i) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question posed by email and (ii) execute and return an Affidavit of Eligibility and Liability/Publicity Release within 72 hours of notification (first attempted delivery) or prize may be forfeited and an alternate potential winner selected. Potential winners will be announced on www.smithmag.net and notified by email within five business days following the end of each contest phase. Odds of winning depend on the number of eligible entries received and the application of the Judging Criteria. In the event of any dispute regarding who is the entrant that submitted an e-mail entry, the potential winner must provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. By entering, entrants agree to abide by and be bound by these rules and the judge’s decisions, which are final and binding in all matters related to this Contest. Any form of entry other than as specified in these rules is prohibited. Prizes will be shipped to winners no later than September 30, 2011.
All entries must be original and entrants agree to defend, hold harmless and indemnify Magsmith LLC (“SMITH”) and Mercer LLC (“Mercer”) against any and all claims of alleged or actual infringement of any intellectual property rights, proprietary rights, rights of privacy and publicity, moral rights and rights of attribution raised by third parties against SMITH or Mercer in connection with an entry. To the extent permitted by applicable law, SMITH, Mercer, their respective parents, affiliates, subsidiaries, divisions, advertising and promotion agencies, or the respective officers, directors, employees or agents of the forgoing (collectively, the “Released Parties”) are not responsible for (i) any injury, losses or damages of any kind resulting from participation in this Contest or acceptance, possession or use of any prize; or (ii) any warranty, representation or guarantee express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, SMITH reserves the right at its sole discretion, with the consent of the Régie des alcools, des courses et des jeux, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest, and judge entries from among all eligible, non-suspect entries received prior to such action. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by SMITH on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
Each entry must be the original work of the entrant; may not have won previous awards; may not have been previously published or used for public display by any third party; must not infringe any third-party’s rights; must be suitable for publication (e.g., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements; may not invade privacy, publicity or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names or third party logos; and may not contain any copyrighted works owned by third parties. All entries will be reviewed for content eligibility and compliance with these Official Rules before being judged. Entries containing false information, prohibited material or inappropriate content, as determined by Sponsor, in its sole discretion, may be disqualified. Sponsor makes the final determination as to what entries are eligible for this Contest and reserves the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Submission of an entry grants Sponsor and its agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such entry in any way, in any and all media, without limitation, and without consideration to the entrant, whether or not such entry is selected as a potentially winning entry and each entrant hereby assigns all copyright in and to the entry to Sponsor and waives all moral rights in and to the entry in favour of Sponsor. By submitting the original entry, the entrant represents and warrants that he/she has all right, title and interest necessary to grant sponsor the worldwide, irrevocable and unrestricted right and license to adapt, publish, use, edit, and/or modify such entry in any way and post the original entry on the internet or use the original entry in any other way and agrees to indemnify and hold sponsor harmless from any claims to the contrary. By submitting an entry, each entrant agrees that the submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the essay/image(s) on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. The entrant acknowledges that, by acceptance of the submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than the entrant.
FOR QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
LIMITATION OF LIABILITY: Sponsor is not responsible for any lost, misdirected, delayed or illegible entries, nor for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of entries. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer related to or resulting from participating or downloading materials in this Contest.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING, REASONABLE LAWYERS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Without limiting the foregoing, Sponsor may disqualify any entrants from the contest who deliberately damage, tamper with or undermine the legitimate operation of the contest.
