The Fine Print & Contest Rules – United States
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Contest Rules and the decisions of the Sponsors which shall be final and binding on all matters relating to this Contest.
ELIGIBILITY: The Contest is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Void elsewhere and where prohibited. Employees of the Sponsors, their parents, affiliates, distributors, retailers, advertising, promotion and judging agencies and the immediate families and household members of each are not eligible.
HOW TO ENTER: Completely fill out the registration form at www.smithmag.net (the “Site”). By registering and then submitting an entry, you are granting the Sponsors the right to reprint or republish your entry (including, along with your name and any photograph) in any and all media, including publication in social media or in a book or other publication.
There are four separate “Six Words About Work” Contests that will take place between June 29, 2011 and August 28, 2011 (the “Contest Period”). During four (4) separate (two) (2) week periods, enter by submitting your original “Six-Word Memoir” – namely, a six-word response to the topic (“Entry”). You may also provide a relevant photograph:
1) Why I do what I do – Entry period June 29-July 16, 2011;
2) What inspires my very best work – Entry period July 17, 2011-July 30, 2011;
3) The best boss I ever had – Entry period July 31, 2011-August 13, 2011;
4) Biggest lesson I learned at work – Entry period August 14-August 27, 2011.
Entry periods begin at 12:01 am (CST) and end at 11:59 pm (CST) on the days stated.
You may enter as often as you like. All Entries must be original and created by the entrant.
SELECTION OF WINNERS: All eligible Entries will be judged by one qualified Judge shortly after the close of the applicable Entry Period, who will evaluate each eligible Entry based on the following judging criteria (“Judging Criteria”):
The Entry with the highest total score will be the winner (“Winner”). In the event of a tie, the tied Entry will be re-judged, and if still tied then the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie will be declared the Winner. Entrants agree that the Judge shall have the sole right to decide all matters and disputes arising from this Contest and that all decisions are final and binding in all respects.
Please retain all submitted Entry materials in their original format after uploading. If you are a Winner, you may be required to provide your Entry materials to Sponsors in the original format as a condition of being awarded a prize. Automated methods of entry are prohibited and any use of automated devices will cause disqualification.
PRIZES: The top-scoring Entry for each topic shall have the choice of receiving an iPad® 32 GB mobile digital device (ARV $700) or a Blackberry® Playbook™ 32 GB tablet (ARV $600) (each, the “Prize”). The total ARV of all four Prizes (per country) is approximately $2,400–$2,800.
Acceptance of the Prize constitutes permission from the Winner for the Sponsors and their public relations/promotional agencies to use the Winner’s name, Prize, state of residence, likeness, biographical information, Entry and photograph for public relations, advertising and promotional purposes online and in print, or in other media, in connection with the Contest without additional compensation unless prohibited by law. Prize is non-transferable. No cash redemption or substitution permitted, except by the Sponsors, who may substitute a prize of equal or greater value. Any and all federal, state, and local taxes, and any other related expenses on Prizes, if any, are the sole responsibility of the Winners.
TERMS & CONDITIONS: Winners will be notified by e-mail and will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release (where permitted by law) within 48 hours of notification (first attempted delivery) or Prize may be forfeited and an alternate Winner selected. Odds of winning depend on the number of eligible Entries received. In the event of any dispute regarding who is the Entrant that submitted an e-mail Entry, the potential Winner must provide the Sponsors with proof that the potential Winner is the authorized account holder of the e-mail address associated with the potentially winning Entry. By entering, Entrants agree to abide by and be bound by these rules and the Judge’s decisions, which are final and binding in all matters related to this Contest. The Winner must provide information necessary (e.g., Social Security number) for issuance of appropriate tax documentation. Any form of entry other than as specified in these rules is prohibited.
All Entries must be original and Entrants agree to defend, hold harmless and indemnify Magsmith LLC (“SMITH”) and Mercer LLC (“Mercer”) against any and all claims of alleged or actual infringement of any intellectual property rights, proprietary rights, rights of privacy and publicity, moral rights and rights of attribution raised by third parties against SMITH or Mercer in connection with the Entry. SMITH, Mercer, their respective parents, affiliates, subsidiaries, divisions, advertising and promotion agencies, or the respective officers, directors, employees or agents of the forgoing (collectively, the “Released Parties”) are not responsible for (i) any injury, losses or damages of any kind resulting from participation in this Contest or acceptance, possession or use of the any Prize; or (ii) any warranty, representation or guarantee express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, SMITH reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest, and judge entries from among all eligible, non-suspect entries received prior to such action. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by SMITH on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
Each Entry must be the original work of the Entrant; may not have won previous awards; may not have been previously published or used for public display by any third party; must not infringe any third-party’s rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements; may not invade privacy, publicity or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names or third party logos; and may not contain any copyrighted works owned by third parties. All Entries will be reviewed for content eligibility and compliance with these Official Rules before being judged. Entries containing false information, prohibited material or inappropriate content, as determined by the Sponsors, in their sole discretion, may be disqualified. The Sponsors makes the final determination as to what Entries are eligible for this Contest and reserve the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Submission of an Entry grants the Sponsors and their agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the entrant, whether or not such Entry is selected as a winning Entry. BY SUBMITTING THE ORIGINAL ENTRY, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE AND INTEREST NECESSARY TO GRANT THE SPONSOR THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT, AND/OR MODIFY SUCH ENTRY IN ANY WAY AND POST THE ORIGINAL ENTRY ON THE INTERNET OR USE THE ORIGINAL ENTRY IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY. By submitting an Entry, the Entrant agrees that the submission is gratuitous and made without restriction, and will not place the Sponsors under any obligation, that the Sponsors are free to disclose or otherwise disclose the ideas contained in the essay/image(s) on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to the Entrant. The Entrant acknowledges that, by acceptance of the submission, the Sponsors do not waive any rights to use similar or related ideas previously known to the Sponsors, or developed by its employees, or obtained from sources other than the Entrant.
By accepting the Prize, Winner agrees that neither the Sponsors, their parents, affiliates, subsidiaries, distributors, retailers, and/or any of their respective shareholders, directors, officers, distributors, employees or promotion/advertising agencies will have any liability whatsoever for any injuries, losses, harm, damage, cost, or expense arising from or in connection with participation in this Contest or any Prize-related activities, or the acceptance, possession, use and/or misuse of a prize including, without limitation, any personal injury or death. By accepting the Prize, Winner acknowledges that the Sponsors, their parents, affiliates, subsidiaries, distributors, retailers, and/or any of their respective shareholders, directors, officers, distributors, employees or promotion/advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to a Prize, including but not limited to its quality or merchantability, or fitness for a particular purpose. Acceptance of the Prize further constitutes Winner’s consent that the Sponsors may use Winner’s name, state of residence, likeness and/or Prize and biographical information worldwide without limitation for advertising or promotional purposes without further compensation, except where prohibited. All Federal, State, and Local laws and regulations apply.
LIMITATION OF LIABILITY: The Sponsors are not responsible for any lost, misdirected, delayed or illegible entries, nor for any incorrect or inaccurate information, whether caused by users of the World Wide Web or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer related to or resulting from participating or downloading materials in this Contest.
OTHER: CAUTION – ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING, REASONABLE ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Without limiting the foregoing, the Sponsors may disqualify any Entrants from the Contest who deliberately damage, tamper with or undermine the legitimate operation of the Contest.
OFFICIAL RULES/WINNER’S LIST: For an additional copy of these Official Rules send a stamped, self-addressed envelope (residents of Vermont may omit return postage) postmarked on or before August 15, 2011 to: “Six Words About Work” Contest Rules, c/o Magsmith LLC, 33 W. 17th St., 7th Fl., New York, NY 10011. The names of the Winner will be posted on the Site on or about September 1, 2011.
